Texas Divorce Requirements

There are a few very important elements of Texas divorce that you need to understand:

No-fault divorce. In Texas, you do not have to prove that your spouse did anything wrong or that there was any marital misconduct in order to divorce. The judge, though, might consider fault in the division of marital property.

Partial and exchange agreements. Under Texas property law, spouses can agree to a partial and exchange division of their community property into separate property. The agreement can be for property that is currently owned or property they might own in the future.

It can include property that is:

• Owned or claimed before the marriage.
• Acquired during the marriage as a gift, devise or descent.
• Recoverable for personal injuries suffered during the marriage (this does not include recovery for loss or earning capacity during the marriage).

Residency. You or your spouse must have lived in Texas for six months or 180 days to be eligible for a divorce.

Waiting period. You must wait at least 60 days from the date of filing to finalize your divorce. Technically, your divorce could be final in 61 days. However, it typically takes from six months to a year or longer depending on the specific issues of your case.

The Divorce Process

Understanding the divorce process can ease some of the stress involved. The process includes:

• Filing the divorce petition
• Giving the notification of the divorce to the other spouse
• Requesting temporary orders (if necessary) for temporary alimony, child support and visitation rights
• Meeting to try to work out an agreement outside of court, often referred to as mediation
• Resolving the divorce in trial if an agreement cannot be reached
